SPCC Plan Reviews

When the SPCC Plan is completed and certified, is it sent to EPA for review?

No. The facility must keep certified copy of the SPCC Plan available at the facility for EPA on-site review, if the facility is attended at least eight hours a day. If the facility is not attended, then the SPCC Plan must be kept at the nearest company office.

Who reviews the SPCC Plan and how often is the SPCC Plan reviewed?

The owner or operator must review the SPCC Plan at least once every three years. The review must be documented, and if the owner or operator awards the plans, a registered professional engineer must certify it.

When must an SPCC Plan be amended?

Following the triennial plan review, the regulation requires the owner or operator to amend the Plan within six months to incorporate more effective control and prevention technology if: (1) the technology will significantly reduce the likelihood of a release; and (2) if the technology has been field proven at the time of the review. The owner or operator must also amend the SPCC Plan whenever there is a change in the facility design, construction, operation, or maintenance that materially affects the facility's potential for discharge into navigable waters of the United States or adjoining shorelines. Such amendments must be fully implemented no later than six months after the change occurs. In addition, an EPA Regional Administrator may require amendments to the SPCC Plan following a single discharge at the facility in excess of 1,000 gallons, or following two discharges within any twelve-month period. Amendments must be certified by a registered professional engineer.
