Contingency Plan Requirements

Who is required to prepare a contingency plan?

The Oil Pollution Prevention regulation requires that an oil spill contingency plan and a written commitment of manpower, equipment, and materials for spill control and removal be submitted to the RA by a facility without adequate secondary containment.

What should be included in a contingency plan?

The regulation requires a detailed oil spill contingency plan that follows the provisions of 40 CFR Part 109. The proposed revisions require that an oil spill contingency plan be a stand-alone section of the SPCC Plan and include, at a minimum, a description of response plans, personnel needs, needs, methods of mechanical containment, steps to be taken for removal of spilled oil, access and availability of response equipment, and any other information possibly required by the Regional Administrator.
